BY BOOKING WITH RED DOUGLAS PHOTOGRAPHY, YOU AGREE TO THE BELOW TERMS AND CONDITIONS.


PHOTOGRAPHY SERVICES:

Payment off the collection fee secures the agreed booking date, and covers the cost of RED DOUGLAS PHOTOGRAPHY'S photographic services, time, editing, equipment, planning, and consultation, and selected amount of digital downloads.


The Tayl Collection: 10 digital images

The Aulder Collection: 20 digital images

The Hame Collection: Full gallery (approx 50 images)


Pricing for above collections are correct at the time of booking as per the Investment page on Red Douglas Photography's website.

PAYMENT:

The collection fee must be paid in full seven (7) days before the chosen booking date. An invoice will be emailed to you with all the relevant details . If invoice is not paid in full, Red Douglas Photography will assume services are no longer required and will not attend.

A 35% retainer of Collection fee is non refundable.


DELIVERABLES:

You final photographs are delivered as high-quality digital JPEG files through a secure online album link received via email.

Images will be provided to you within four (4) weeks of the shoot date, subject to editing times required.

Based on the Collection chosen, you may then choose any image from the gallery to download, up to your chosen limit. These will download directly to your device.

Additional digital images can be purchased if required, as well as fine art prints.

*Watermark on images inside the gallery will not be present once downloaded.


COPYRIGHT & INTELLECTUAL PROPERTY:

All photographic materials taken by Red Douglas Photography, such as original negatives, photos, or slides, shall remain the exclusive property of Red Douglas Photography.


CLIENT’S USAGE:

Red Douglas Photography grants you an exclusive, irrevocable, royalty-free, non-transferable license to use the images for personal use only. Red Douglas Photography grants you the right to make an unlimited number and format of copies of the photographs in any medium. The photographs may also be shared with third-party vendors for printing, album creation, or other related services. You may distribute the images as you wish and obtain prints by your own means if you opt for digital downloads.

You agree that you will, under no circumstances, alter any photographs and agree that they cannot be altered in colour, or edited in any way.

Copyright logos, if applicable, cannot be cropped out, or removed by you or any third party.

You shall not sell received images for profit.


SOCIAL MEDIA AND ONLINE:

When publishing images online, it is required that a citation of Red Douglas Photography be made by way of tagging Red Douglas Photography's social media business page, or providing a link to Red Douglas Photography's website. You agree to be responsible for any family member or friend who post the photographs online in relation to the above editing and usage clause.


ARTISTIC STYLE:

You acknowledge and agree that you have reviewed Red Douglas Photography's previous work and portfolio and have a reasonable expectation that Red Douglas Photography will perform the services in a similar style, that Red Douglas Photography will use their artistic judgement when providing the services, and shall have final say regarding the aesthetic judgement or artistic quality of the services and editing of final images. Disagreement with Red Douglas Photography's aesthetic judgement is not a valid reason for termination of this agreement or request of any monies returned.

You acknowledge that Red Douglas Photography's editing style and creative vision are integral to the final images. All edits and adjustments made by Red Douglas Photography are considered final, and no additional re-touching or alterations will be provided unless agreed upon in writing, and may, at Red Douglas Photography's discretion, incur additional fees.


IMAGE EDITING:

All deliverable images will have standard image editing, as per Red Douglas Photography's creative style, and discretion. Any extra, specific edits, or re-touching requested by you will incur an additional fee, to be determined by the work requested. This will be billed on a separate invoice, and Red Douglas Photography holds the right to retain the images until this additional payment has been made in full.

While care will be taken to aid in your satisfaction, Red Douglas Photography will not be held liable for your dissatisfaction with the final images.


USE IF ARTIFICIAL INTELLIGENCE (AI):

Red Douglas Photography may utilise artificial intelligence (AI) tools as part of their workflow. This includes, but is not limited to, editing processes such as the removal of minor distractions, background refinement, and general image enhancement. AI is not used to materially alter the appearance of individuals, fabricate subjects, or generate images that were not captured during the session.

AI tools may also be used to assist in written communications, marketing materials, and documentation. All final images and deliverables remain a true and accurate representation of Red Douglas Photography's work and creative intent


COMMUNICATION:

All communication with Red Douglas Photography shall be made in English and in writing via phone, or email.

Any changes to bookings must be made in writing.


BOOKING CHANGES:

It is understood that it is your responsibility to inform Red Douglas Photography in writing at least seven (7) days before the booking date of any changes to the agreed booking (date, location etc). Red Douglas Photography will use commercially reasonable efforts to accommodate your change. If Red Douglas Photography is unable to accommodate the change, despite using commercially reasonable efforts, the parties agree that such rescheduling will be deemed as a cancellation by you, and Red Douglas Photography will be under no obligation to perform the services other than on the originally booked date, and the below terms of cancellation are applicable.

Red Douglas Photography is not liable for missed communication if notifications are sent via social media. Feel free to text, and to follow up if no response has been received, or call for anything urgent.


CANCELLATION / RESCHEDULING:

You may terminate this agreement and/or reschedule the services by providing Red Douglas Photography with written notice no later than seven (7) days before the booking date.

Notification of cancellation by you or Red Douglas Photography must be submitted in writing.

In the event of a cancellation within the time frame, sufficient efforts will be made by you and Red Douglas Photography to reschedule the appointment to another date. All monies paid will be transferred to the new booking date. If another date cannot be agreed on, you forfeit the 35% retainer of the Collection fee.

If sufficient notice is not provided, Red Douglas Photography reserves the right to retain all monies paid, at Red Douglas Photography's discretion.

You acknowledge and agree that you are not relieved of any payment obligations for cancellations and/or rescheduling unless the minimum notice is duly provided, or unless the parties otherwise agree in writing.

Neither party will be held in breach of or liable under this agreement for any delay or non-performance of any provision of this agreement caused by illness, emergency, fire, strike, pandemic, earthquake, or any other conditions beyond reasonable control. If any event is deemed to be for an extended period of time, equal to the duration of the conditions preventing performance on the booking date, then the non-effected party is free to terminate this agreement. Any applicable fees paid to Red Douglas Photography may be refunded, including the 35% retainer, which will be considered on a case by case basis.


In the event Red Douglas Photography is unable to perform the services on the booked date, and is unable to attend, Red Douglas Photography shall terminate this agreement and will refund the Collection fee paid, which may include the 35% retainer, subject to any costs Red Douglas Photography has incurred in relation to your shoot (eg. props, fees).


Red Douglas Photography can cancel your contract due to any aggressive, disrespectful, or otherwise unwanted or entitles behaviour from you, without refunding any monies paid.


MODEL / MINOR RELEASE:

By entering into this agreement, you acknowledge and agree that Red Douglas Photography may use the photographs for display purposes, marketing materials, portfolio, online galleries, social media, competitions, and other promotional efforts. You acknowledge that the photographs may be shared with third-party vendors for printing, album creation, or other related services.

You hereby grand Red Douglas Photography the irrevocable right to use and publish photographs of you or any subjects participating in the photography session (hereinafter referred to as 'the models') for editorial, trade, advertising, competitions, or any other purpose, and in any manner and medium; to alter and copyright the images without restriction. You release all claim to profit that may arise from the use of these images.

You agree that Red Douglas Photography may use the photographs without further compensation or communication with you or the models, and releases Red Douglas Photography from any and all claims, demands, or causes of action that you or the models may have in relation to this authorisation or in use of the photographs.

As the guardian of any minors included in the shoot, you hereby give permission for Red Douglas Photography to use these images in all ways mentioned above.


TRAVEL:

Red Douglas Photography is able to service all of Australia. If any excess travel or accommodation is required, then the below clause applies.

All travel requirements can be discussed and negotiated with Red Douglas Photography and travel costs will be added to final invoice or provided in separate invoice, which is to be paid in full as per PAYMENT clause above.

Flights and accommodation will be booked by Red Douglas Photography and paid for by you (cost of flights and accommodation will be determined on availability at the time of booking).

Reasonable efforts will be made by Red Douglas Photography to keep travel fees to a minimum, taking into consideration the availability, quality, and extras required from flights, accommodation, and car hire.


LOCATIONS / PERMITS:

It is Red Douglas Photography's responsibility to obtain permission for entry and photographic permissions at all applicable locations. Red Douglas Photography will communicate any restrictions or policies in place at all applicable locations to you. It is all parties responsibility to abide by these policies.

You may be responsible for the cost of obtaining any required permits or entry fees for the location chosen, if applicable, on top of the fee for the photographic service.


INDEMNITY:

You agree to indemnify, defend, and hold harmless Red Douglas Photography and their affiliates, employees, agents, and independent contractors for any injury, property damage, liability, claim, or other cause of action arising out of or related to the services that Red Douglas Photography provides to you.


LOSS OR DAMAGE:

Red Douglas Photography undertakes to use the utmost care and reliable equipment throughout the capturing, backup, processing, and transportation of the images.

However, if the images are lost due to failed equipment, theft, fire, or any other unforeseen circumstance, Red Douglas Photography will re-do the shoot free of charge, if applicable to do so. If not, the full amount paid, including the 35% retainer, will be refunded to you.

Images are kept backed up on file for a reasonable period of time.


PROMOTIONS / GIFT CARDS:

When booking using a promotional code or gift card, the booking must be made before the expiry date listed on the promotional materiel to receive discount.

The shoot date can be after the end of the promotion, as long as the booking is made before the end of the promotion.

Discount code must be quoted at the time of booking to receive discount, and cannot be applied after payment has been made.

One promotion / gift card can be used at one time, per person, unless otherwise stated or negotiated.


CONFIDENTIALITY:

All information and discussions between you and Red Douglas Photography are considered confidential and will not be disclosed to any third party.


PHOTOGRAPHER BREAK:

If the photography shoot is to take five (5) hours or more, Red Douglas Photography will be entitled t o a one (1) hour break at their own discretion, and bathroom and drink breaks when necessary.
